The purpose of a buyer's final walk-through of a property just prior to close is to verify that the seller has maintained the property in the same condition as when the buyer went into contract. It's also to make sure that the seller has completed any negotiated repairs. 

Generally a walk through is scheduled within seven days before the closing.  A walk-through is important-- you don't want to close on your new home then move in to find scratched hardwood floors from when the Seller moved out, or trash left in the garage. Other problems I've seen come up during walk throughs are doggie-doo in back yards, removal of attached appliances (like microwaves) or even the removal of walls and doors (!).

A walk-through cannot serve as recourse so you can get out of the contract. It's sole purpose is to verify property condition.  However, If the property has not been maintained, or the seller hasn't completed the required repairs (or not done them properly), you and your agent should try to get the seller to make the corrections prior to close of escrow (COE).  

If repairs cannot be completed on time, you can:                        

A.  Extend the close of escrow to allow seller time to do the work.              

B. Negotiate a credit from seller for buyer to complete the work after close of escrow. The amount of the credit should be enough for you to complete the repairs or maintenance.              

C. Have seller and buyer agree to a hold-back of funds for seller to complete the work after close of escrow. We try to avoid this last option-- things can get very sticky when the seller or the seller's contractors hae to come out to work on your new home. We've often had instances where the seller never completes the work, delays on doing the work, or our client and the seller don't agree on how the work should be done.    

If issues arise during the walk-through that can't be resolved, you may cancel the contract. But this last resort should only be taken with the advice of an attorney who can  confirm that the seller actually is in breach of the contract because of seller's actions or failure to act.

Wailea Gateway Center is open for business in Wailea Maui HI

Wailea Gateway Shopping Center in Wailea Maui Hawaii is now open for business.  This is just happening and currently there's not much open.  You will find a Greek restaurant Pita Paradise, Da Beachhouse, Subway Sandwiches, Water Lily, and a few other businesses including real estate sales and property management for the Wailea luxury market.  Merriman's Restaurant is coming soon.  It's a couple of 2 story commercial buildings with the Wailea look, facing the mauka parking lot.  Ocean views can be enjoyed from the upper floor windows.

Wailea Gateway Center on Maui - Pita Paradise

The Wailea Gateway Shopping Center is located at the corner of Wailea Ike drive and Piilani Highway.  If you just drive to the end of the Piilani Highway, you will have to turn right and go by it.  Stay in your right hand lane and you will catch the entrance.  Plenty of parking now.  Next door you'll find the Bluffs at Wailea - a very expensive gated subdivision with large lots and amazing ocean views.  Nothing being built in there yet, and no wonder, with price tags like that!

A sick Blainville's Beaked Whale was rescued off a Kihei beach on Monday and transported to the Hawaiian Cetacean Rehab Facility at the University of Hawaii-Hilo on the Big Island.  The dehydrated and hungry whale has been the subject of testing, and is in stable but guarded condition, eating liquified squid.  These rare marine mammals live in deep water and are hardly ever seen by humans.

If you're visiting Maui, or even if you live here, don't forget to do some browsing and shopping upcountry in the little town of Makawao.  This cowboy inspired village has some unique attractions, not the least of which is the Komoda Bakery with their famous pies.  There's plenty of art galleries and gift shops featuring island art and crafts.  Need some cowboy boots or a leather jacket?  If you're looking for some trendy clothing, check out the boutiques like Aloha Cowboy and Collections.  Makawao is also the home of the famous Volcano Spice Company.  When you get hungry or need a pick me up, there's coffee shops and restaurants of all kinds.

Makawao is upcountry and can be part of your Haleakala day out.  It's a great way to spend the afternoon, if you're not in a big hurry.  It's only about a 10 minute drive up the mountain from the beach town of Paia, up Baldwin Ave..  If you take the Haleakala Highway from Kahului, take a left when you get to Makawao Avenue (Hwy 400).

Moving to Maui and finding a job - liquor certification card

If you're moving to Maui Hawaii, or looking for a job on Maui, here's some useful information to get you started in the food and beverage industry.  

Maui County requires that any person serving alcohol needs to have their liquor certification, and be at least 21 years of age.  You can find all the study material online, and then take the test in person, at either of 2 locations, Wailuku or Lahaina.  Lanai and Molokai have their own locations for the test.

Here's the link to the Maui County Department of Liquor Control Certification Exam.  At the bottom of the page you'll find the study material links... 3 of them.  Read through it all and know the material.

This certification is really important, and if you have the card you can get hired right away.  The testing is limited to 2 days a week in Wailuku, and 1 day a week in Lahaina.  They close for holidays too.  This can really slow you down if you want to get working NOW.

  • a massive shield volcano comprising more than 70% of Maui
  • 10,023 ft elevation, 3,055 meters = highest point on the island of Maui
  • temps between 40°F (5°C) and 60°F (16°C)
  • part of the National Park System

  • "ahinahina" is a protected and monitored plant
  • part of the aster family
  • succulent leaves covered in velvety fine silver hairs
  • lives only here at Haleakala Maui
  • usually flowers July through October and can be 6' tall

 

Haleakala Crater - Sliding Sands Trail

  • round trip 11 mile trek is fairly strenuous
  • bring plenty of water and snacks 
  • there's no shade, bring a hat and sunscreen
  • the trail is sandy with loose rock

 

Directions: From Kahului, take Hwy 36 to the 37 and 377 (Haleakala Hwy), which leads inland into Maui’s Upcountry region. About 0.5 mile beyond Kula Lodge, turn right onto the winding 378 (Haleakala Crater Rd) to the Park entrance. Beyond Park headquarters, Crater Rd switch-backs up the volcano to Haleakala visitor center.

iphone home screen I know the battery was not dead but the screen would not light up. It was a black screen and I could not turn my phone on no matter what I did. Oh no my iPhone is dead. What am I going to do?  Talk about a gadget headache.

As soon as I could get to another computer I Googled my iPhone screen is black. What do I do. I found a help chat with the solution.  You just have to hold down the start button and the home button at the same time for at least 10 seconds.  Actually it took about 12 or 13 seconds and then the apple logo came on the screen on my phone started up.  What a relief!  Now I know how to fix my iPhone when it goes black, and I also know to just Google for help.  I hope that's the last gadget headache I ever have.

Aloha Friday - Pictures from Hana Maui HI 96713

I did the drive to Hana Maui yesterday... there and back that is.  I needed to take some pictures and video of a listing, for a mainland client.  It's a house and cottage on 9 acres, in a quiet setting up above the coastline, and surrounded with jungle and tropical flowers.  But more about that later.

What a beautiful place Hana is, and what a great day it was.  It's just so peaceful and relaxing there, and it made me want to stay.  Got a lot of nice pictures and want to share some now...

The little island is off the coast of Hana, but I don't remember the name of it.

Those plumeria flowers really are that brilliant!  I did not retouch the photo.  And they smell delicious too.

There were 2 of these huge carved tikis in front of a gated estate.  They must have been 8' tall.  You know I just had to stop the car for that!

I hope you enjoyed this little glimpse of island style living from Hana Maui!

This is such an amazing picture!  it looks like it was taken out west, but actually i took the pic in Lowgap, NC.  The sky was a great backdrop - i had to stop the car and climb up a hill and lean over a barbed wire fence - but the horses were very curious so I had no problem keeping their attention...

This is the best part of my job - just seeing new things every day!

This question is presented to me enough times that a blog answer is in order.

REO stands for Real Estate Owned and refers to a bank owned property that has failed to sell at a foreclosure auction or trustee sale.

The truth is most foreclosure auctions actually turn out to not draw any bidders at all. This is because the owner of the property typically owes more to the lender than the total market value of the property, and this poses a major barrier to a successful sale.

This makes sense, considering that if there were enough equity in the property to cover the loan, the owner would have likely sold it and paid off the bank, avoiding the need for a foreclosure.

Money wrestling

After a property fails to sell at a foreclosure auction, its title is reclaimed by the mortgage company, and it officially becomes an REO property.

Once the financial institution takes ownership of the property, the mortgage loan ceases to exist, and the residents are usually evicted. The bank will
handle any outstanding items owed by the prior borrower, such as homeowner’s association fees, and will negotiate with the IRS for removal of any tax liens against the property.

I really don't feel that relaxed when I'm trying to do this, so I think it's just a matter of practicing until it feels natural.  I made about 6 test videos before this one!  This one is passable for now.  I really want to be able to do a live stream from Maui properties, as we get a lot of buyers from off-island.  This should really make things easier, I hope!
